This course provides an introduction to the Mental Capacity Act, helping learners understand its key principles, how to assess capacity, and how to support individuals to make decisions in a lawful and person-centred way.

Learning Outcomes

The Mental Capacity Act course provides learners with a clear understanding of the background and key policies that underpin the Mental Capacity Act and its importance within health and social care practice. Participants will explore why the Act was introduced, including the need to protect individuals who may lack the capacity to make certain decisions, while also promoting independence, choice, and empowerment. The course explains who the legislation applies to and how it supports both individuals and professionals in decision-making processes.

Learners will examine the five core principles of the Mental Capacity Act, gaining insight into how these principles guide lawful and ethical practice. The session highlights the importance of presuming capacity, supporting individuals to make their own decisions wherever possible, and ensuring that any actions taken are proportionate and respectful of individual rights.

The course introduces how to assess mental capacity using the two-stage capacity test, helping participants understand when an assessment is required and how to carry it out in a decision-specific and person-centred way. Learners will also explore Best Interests decision-making, understanding how to make lawful decisions on behalf of someone who lacks capacity while considering their wishes, feelings, beliefs, and values.

Throughout the training, participants will build confidence in applying the Mental Capacity Act within their roles, supporting safe practice and ensuring decisions are made in a way that protects dignity, rights, and wellbeing.
